Planning, Building and Plant Construction

Our expertise

Private building law / plant construction

We know what matters when it comes to real estate projects and plant construction. It is our and our clients’ goal to equip projects with the legal structure required to meet all quality, deadline, and budget specifications.

Hence, during project realisation, we start by helping our clients choose the most suitable contract and procurement model (individual awarding of contracts, use of general contractors employing their own staff (Generalunternehmer)/use of general contractors employing subcontractors (Generalübernehmer) as well as the awarding of contracts based on a Guaranteed Maximum Price (GMP). When it comes to assistance with and the designing of large-scale building projects based on new contract models such as the integrated project delivery, scheme, you can count on some leading experts in our team.

A further core competency of ours lies in the provision of advice on projects during the construction phase. What matters to us most of all is to establish early on which aspects are likely to result in disagreements, avoid disputes whenever possible and, by doing so, arrive at the decisions required to ensure the success of a project. During that phase we are often part of our clients’ project team and pursue a holistic and interdisciplinary approach while cooperating with project managers, building technicians, construction engineers and surveyors.
Our team also includes a group of experienced litigators. Assisting with large-scale projects acting on behalf of principals and contractors, they have a wealth of experience with complex judicial and extrajudicial disputes, which they put to good use for the benefit of our clients.

Architecture and engineering law as well as project management

We advise principals, planning offices and project managers on all facets of project management, architecture, and engineering law. Our advice covers all project phases in that field: we choose the contract model that is most suitable for the projects, we draw up the architecture, engineering and project management agreements and advise our clients on all aspects of remuneration law including assertion of and defence against claims for additional remuneration made by the parties concerned.

Our experts also offer advice on copyright and liability issues as well as on how to conduct lawsuits. In addition, we are familiar with the BIM (Building Information Modelling) method of planning, the resulting new forms of cooperation and legal relationships between the parties concerned and can make the legally necessary contribution to the implementation of the BIM method in planning and construction processes.
