When it comes to project delivery RITTERSHAUS likes to offer advice that reflects the firm’s comprehensive and anticipatory approach at the start of a property’s life cycle. Early on, during the initial phase, we look at all issues involving civil, public, and fiscal law. We undertake a comprehensive analysis of the development project from the start, and together with our clients we try to achieve innovative and customised solutions. In most cases, our consultation starts with the idea and choice of location for the real estate project and includes planning, financing, the procurement of building rights and the building phase as well as the utilisation or management of the project.

We design and set up the necessary companies, optimise the fiscal structure, advise clients on project financing as well as land acquisition and the subsequent sale. We offer comprehensive advice on the drawing up of zoning plans and urban planning agreements including all ancillary fields, in particular aspects of immission and species protection as well as soil protection law or negotiate and develop schemes to meet the housing needs of the local population (Einheimischenmodell). We also provide advice on projects that are subject to special laws such as wind parks or infrastructure projects in accordance with specialist planning laws.

Apart from project developers, builders, financing bodies and investors, it is also towns, cities and local councils that benefit from our expertise in the industry. We involve all parties concerned when it comes to drawing up the necessary agreements. Setting out the roadmap involving many important decisions at the start of a real estate project. Even if we can never foresee and plan for everything, it is essential for any successful project delivery that we ask the right questions at the start of a property’s life cycle.

Have building rights been secured? Does the “right” company purchase the plot? What aspects must still be agreed with the local council? Will the rights of neighbours impair the main aspects of the development? What happens in terms of real estate transfer tax if there is a change of project partner? Does the joint venture agreement pay sufficient attention to the financing aspects as well as any unforeseen developments? What about contaminated soil and immission protection?
